destroyed evidence
okay can i sue the state or city if evidence in a murder case was destroyed while it was a ongoing investigation and the dna was never enterd in the data base because it was destroyed and wasnt told untill now 23yrs later

While it depends on certain facts, the likelihood is that you cannot. Even if you could sue the state, there is a $100,000 maximum unless you get the Florida legislature to pass a special bill to increase that amount.
