dismissal of charge

i have not been arrested or notified of a may 2008 battery charge i found it was pending upon trying to visit an inmate i have no warrant. must the state remove this from my record?

well if it is a misdemeanor battery charge, the state has up to one year from the date of incident to file charges against you. If it is a felony battery, then the state has at least two years to file charges against you. If they have not done so in that time, then the charge/case cannot be filed and you cannot be prosecuted for it. All my best, Joe Vredevelt
