can i get into a diversion program in florida without the help of an attorney? it is for retail theft of $100 and i have never been in touble before.

Yes it is possible but if you get rejected for any reason, you would probably wish you had the attorney then.

I agree with my colleague. Diversion programs are controlled by the State Attorney's office and vary from county to county, so while you're likely to qualify, the process that gets you in to diversion varies from jurisdiction to jurisdiction. You'd be better served having an attorney in place to ensure that you get into diversion and that your rights are protected throughout the process. Once diversion is over, you should also have your attorney prepare your case for expungment, so that the record can be cleared of the offense.
