Diversion programs are controlled by the State Attorney's office and vary from county to county, so while you're likely to qualify, the process that gets you in to diversion varies from jurisdiction to jurisdiction. You'd be better served having an attorney in place to ensure that you get into diversion and that your rights are protected throughout the process. Once diversion is over, you should also have your attorney prepare your case for expungment, so that the record can be cleared of the offense.
