It is up to the officers who respond to a call to determine whether or not an act of domestic violence has occurred. Apparently, the police thought one had been committed. The temporary stay away order will stay in effect until a judge has the opportunity to hear testimony from both sides. It is usually held within a 2 week period from the date the temporary order was entered.
