Legal Question in Criminal Law in Florida
double jeopardy
If someone was charged with domestic violence and the charges were dropped can they be charged for the same crime again at a later date? Is this not double jeopardy as the charges were already dismissed?

Re: double jeopardy
Unfortunately, it does not sound like double jeopardy would apply. It depends on how far the prior charge progressed.
For whatever reason, the state can drop a charge and re-file it at a later date. If you would like to discuss your case in greater detail, please contact my office at your convenience.
