Legal Question in Criminal Law in Florida
Drug charges, repeat offender, late for court date, warrant--arrested
My brother was convicted of grand theft 3rd degree, poss. of cannabis, uttering a forged instrument, he served one year in prison. Two months ago he was arrested for not having his vehicle registered, no insurance, poss. of drug paraphernalia-crack pipe, poss. of cocain-residue. He was released on his own recognizance, but due to an oversight, was late for his court date. Instead of immediately getting a lawyer or turning himself in, he panicked and waited for them to come get him, which happened two days ago.(He did immediately take care of the registration and insurance as soon as released) What are his chances of getting bonded out? What are his chances of drug rehab? jail time? probation? I know everyone must pay for their crime, but I believe rehab is what he needs, jail will only make his drug habbit worse. Any help you can give would be appreciated.

Taking care of his registration, et al, was a good move. Waiting to get picked up was a bad move. Not knowing more it is hard to say what he is looking at. The circumstances seem to indicate a drug abuse situation. His best chance is to seek an in-patient treatment facility. If he completes it successfully he "May" be able to avoid more jail.
Bond should not be a problem, but because of the circumstances it will be higher than originally set.
