Drug charges
My son is charged with two counts of drug trafficking for prescription drugs, drug possession and he was arrested on church property.
The two charges for trafficking hold mandatory 3 year prison sentence. He is in his 20's, never been in trouble before. I've read something about a safety valve provision. Will this apply to this? is there any chance he may not have to serve prison time? He is awaiting trial on house arrest. He served 30 days in jail.

First I'm sorry for your situation. If your son was less than 21 at the time of arrest then perhaps the judge could sentence him as a youthful offender. If not then in my experence I have offered to have my client cooperate with the police. Your son's background and any possible defects with police conduct may also induce a good plea offer from the State. Call me at anytime if you have any questions. Good luck.

Safety valve is a term used in Federal cases not State cases. The State can offer a wide range of pleas depending on the strength of their cases. Your son needs a good lawyer who is aware of sentencing options and how to defend a drug case. Please call me if you are seeking representation.

I agree with both of the prior answers. Even though your son's case calls for a mandatory/minimum prison sentence, there are a lot of options and things that can happen on a Trafficking case. What county did this occur in? Most counties have a procedure for providing "substantial assistance" on these types of cases. When looking for a lawyer for your son, you should look for an attorney with prior prosecution experience or someone who is very familiar with the procedures at that specific State Attorney's Office. Each one varies.
