Re: Drug Possesion

The Judge can't drop your charges. The Judge can dismiss the charges in response to a motion to dismiss that is filed on your case. This will only be granted if there is a legal deficiency in the evidence against you.

Your case won't be dropped by the State simply because 2 co-defendants elect to "take the charges". Sometimes an agreement can be worked out ahead of time and you'll know if the State will drop your charges. The state doesn't have to drop anything just because someone is willing to say you were not involved. In fact, their deal may be contingent upon them testifying against you.

It can get complicated when you have multiple co-defendants. Your attorney should have contact with the prosecutor to figure out what the impact of the co-defendants entering a plea would have on you.

Good Luck,

Kendall Horween.
