Legal Question in Criminal Law in Florida
DUI0.8 + concern with quality legal coverage
over 1 year ago my son dui 0.8--the lawyer wants to go to trial stating a 50/50 chance--this is not what he said a year ago. my son also had a run in 6 months later with resisting arrest and battery he was beaten up badly by police. since then he has been in aa and working has college degree and good job and is really rehabing himself.the lawyer says each case has nothing to do with eachother.the state offered 16 month probation for the barroom brawl --no trial okay? my son wis okay with this. the lawyer wants him to take it and then a trial for dui with 50/50 chance. he has been to driving school counciling AA since but i feel if convicted of dui and on probation for the other he could face jail.I feel the lawyer has not really be clear and i would like to speak with another but is it ethical to change at this point? The bar thing happened on his birthday when his friends took him out and he doesnt remember a thing so the lawyer want him to take state offer--okay but the dui / what if he is convicted in a trial afterall 0.8 is the legal limit-how do you fight that.my son has letters from peers employment counseling and is really on a positve path and has paid this lawyer himself mostly. i want honest legal advice on his behalf.

You can change your lawyer any time, just the way you canchange your hairdresser or your doctor. Trial is always 50/50. A breath of .08 causes there to be a presumption of impairment under law
