Legal Question in Criminal Law in Florida
dui, suspended license, hit and run, and failure to appear
brother was picked up for dui, hit and run, driving w/supsended license. He bonded out, but failed to appear. He is now back in jail. I went to see him tonight and was told I could not. I overheard a guard talking about him being in emergency room. I called around and found that he is in a local hospital. Not sure why (and nobody will tell me), but suspect he is detoxing from alcohol. He will be arraigned on feb 12, but is a hard-core alcoholic. I am the only family in the state of FL and am 2 hours away. What do I do? He is sick and needs help, but it would probably be against his free will. Any advice would be really helpful. He is a college educated 40'ish man who has lost everything, including his job. I am afraid to bond him out again since he did not appear the last time. I am also afraid of leaving him in while he has medical issues. Help please!

There are a couple ways to go. One is using the charges pending against him and getting the Court to sentence to an inpatient treatment facility. He gets day-for-day jail credit. The other is to pursue involuntary commitment under the mental health statutes.
