Legal Question in Criminal Law in Florida

Early Termination of probation

I am currently on felony probation and I'm eligible for early termination this October according to the terms of my sentence. However, I am paying restitution. If I haven't finished paying restitution will the judge allow for early termination?

Re: Early Termination of probation

I agree. It will not be possible without having paid restitution in full.

Re: Early Termination of probation

Most judges won't allow for early termination until you've completed all the terms of your probation, including payment of restitution.

Re: Early Termination of probation

That's an easy one. NO! The judge most likely will NOT grant your motion for early termination if you are still paying restitution. Early termination of probation is discretionary and the Judge should only grant an early termination for a person who has "completed" all the terms of probation. If you still owe money, you haven't completed all the terms of probation.
