Legal Question in Criminal Law in Florida
An employee was paid via direct deposit without submitting a timesheet. She was paid $314 more than she should have. She left the following week. When confronted, she wrote a bad check. What is my recourse since I paid her without a time sheet?

Writing a check that one knows to have insufficient funds is a criminal act, though it may be difficult to prove that she knew that there were insufficient funds. You could sue her for the overpayment but it will be your word versus hers, unless you have other evidence or witnesses.
