if i encounter police or am stopped by police is it legal in florida to video record them while I'm in their presence?

Yes you could video, but whether audio of the encounter could be recorded is a grey area depending on the exact location. Of course, if you tell them they are being recorded, then it is perfectly legal, as they are recording you as well most likely.
