Enhancement under Fl law
Can out-of-state convictions be used to habitualize an accused in the state of Florida with no prior Fl criminal record.

The simple answer is yes. The more detailed answer is regarding what you are charged with, and what kind of habitual you are speaking of in regards to habitual driving offender, or habitual felony offender. In regards to the first charge there are different kinds of charges for DWLS in other states, i.e. with knowledge and without knowledge, that may effect a habitual designation. For the habitual felony offender, there are certain crimes that they can use to qualify you and certain ones they cannot. You need to consult with an attorney regarding those issues.
