Legal Question in Criminal Law in Florida

In the event that a spouse has been caught embezzling, without the knowledge of the other partner and the company wants restitution but the spouse does not have a job that will allow paying them back can they come after the spouse who was not involved> And if they can, would getting a divorce stop that?

In short, a crime is only connected to those persons involved. If one spouse did not know then they would not be on the hook for any restitution. Whether it could be part of a negotiated divorce may be another matter entirely which should be addressed to a family law attorney.
