In a criminal case, an evidentiary hearing is any hearing where the judge receives testimony or documentary evidence from one or both parties (State/Defendant). Criminal lawyers utilize evidentiary hearings to resolve disputed issues of law and fact. For example, a defense attorney who has filed a motion to suppress evidence will utilize an evidentiary hearing to elicit testimony which supports his or her application of the law to facts of the instant case.
