Legal Question in Criminal Law in Florida

An ex-best friend of my sisters was jumped by a two girls... Two other girls attempted to get the attackers off of the exbest friend. So what I'm trying to understand is why my sister is going to court for battery? She never layed a finger on the victim; and we have a video to prove that she was screaming at the girls to stop attacking the exbest friend... What do we do?

You get your sister an attorney who can present the video to the prosecutor. The attorney may be able to convince them to dismiss the charge. Also, it could end up being used for a jury as well in order to find her not guilty. When it comes to why she was charged in the first place, the police sometimes just make a guess based on all the stories they hear at the time and decide based on that. However, she is still presumed innocent so it is crucial she get an attorney now.

Normally a jury decides the facts of a "he said, she said" situation. However your sister should hire an attorney before trial to review all the evidence and perhaps get the prosecutor to review the evidence as well. The prosecutor could decide to fie a nolle prosequi (drop the charges) after such a review.
