Legal Question in Criminal Law in Florida
Expunged and sealed record
In 1981 i expunged and sealed a record and then worked for the state of fl for 22 years, went through several background checks by government and never was notified i had a sealed and expunged record. Then i applied for a job with my church in 2006. They ran a federal and state work release program and they said that the us prison system came back with a sealed and expunged record and i had to have it opened if i wanted the job. I refused as i feel this has never came up in 20+ years and i paid to have this record removed according to law. I have gone to courthouse and researched it and there is no record on file. What can i do??? As this was very humiliating and now i can't attend my church because i am too embarassed.

Re: Expunged and sealed record
I have seen this issue in my practice before. Any employer can require disclosure of seal/ expunged records. If you choose not to open them, you wont get the job. Its thats simple. if I were your lawyer I would get them opened and then try to limit what the church could take. Obviously they are looking for sexual offenders.
