Legal Question in Criminal Law in Florida

expungment of disorderly intoxication

I am a middle school teacher in Florida and have been arrested for disorderly intoxication. I was at a baseball game and was with my younger brother (hot head)and he was involve in an argument with another fan. I did nothing but remove him from the situation. The other fan was not arrested and I spent a night in jail for no reason.

I have just learned that even though I can get the charge expunged it will still show on my record if I apply to another school. I would like to fight this because it has a direct effect on my employment and future income.

Help!!

Re: expungment of disorderly intoxication

Depending on how the charge was resolved will control whether it can be expunged. It is correct that a public school may be able to access a sealed record.

I agree with the last answer. However, its unclear whether your disorderly intoxication charge is pending or whether you have already resolved it. Assuming you have no prior record, you may want to consider a pretrial intervention program where your charge will be dismissed upon completion. I would still try to get your arrest record expunged as it would create a lot less of a paper trail concerning the whole incident. If you have any questions about the expungement process, I would be more than happy to assist you.
