Extradition

If a defendant waives extradition from NC to FL, how long does FL have to come pick them up? If they are not picked up within that time frame what happens? Are the charges dropped or transferred to NC? Probation violation and fugitive from justice are the current charges. Thank you for your help.

It all depends. Not the answer that you wanted, but it all depends on what the underlying charge is. The state of Florida does not extradite everyone arrested. On a simple drug charge, they may deny to bring him back, but on a more serious charge they would go to the expense to pick him up.

I had a client arrested outside of the state of Florida more than once on the same warrant for failure to appear, but because it is a minor felony the state has declined to pay to bring her back. She stays in jail for a week or so, giving FL enough time to decide if they want her, and then once Florida declines they release her.
