Legal Question in Criminal Law in Florida

extradition time limits

My husband has a warrant for arrest in Ill. for obstruction justice, and v.o.p. He was taken to a hospital in Fla. (where he was working) for a medical condition of his, and was arrested for the warrant after his release from the hospital. Ill. said they would come and get him. How long can fla. hold him if Ill. dosn't come in a timely mannor to extradite him. I was told 10 days by a friend but I am not sure

Re: extradition time limits

This is a complicated question but the simple answer is as follows. The ten (10) day time period relates to a procedural deadline for the filing of extradition paperwork. That dealdline can be extended for good cause. Once extradition is ordered or the person waives and agrees to return to the requesting state, the state that wants him must get him within a reasonable period of time. What is a "reasonable period of time" varies greatly with Florida depending on the court.
