Legal Question in Criminal Law in Florida

Failure to appear misdemeanor charge

I was arrested in 2003 on misdemeanor resisting arrest and public drunkedness. I plead no contest and was told to pay the court $300 in fines and an apology letter. I mailed these items and only come to find out from a police officer yesterday that there is a warrant out for my arrest in Escambia county for failure to appear. I never received a notice that my payment was not accepted and I also never recieved any notice of having to appear in court again. I live in Orlando now but I am in the process of moving to Virginia Beach with my boyfriend who is in the military. I have a laywer in Pensacola who handled my previous case and I am just wondering what to do? I am terrified of going to jail. What is the best course of action for me to take? Please help, I am very upset. Thank you.

Re: Failure to appear misdemeanor charge

This is a relatively easy matter for you tom resolve. I would first call the Clerk of Court for Escambia Cty...Criminal dept--misdemeanor div. and politely ask the person if he/she would look up your case on the screen. He/she should be able to tell you the status.

Did you get put on probation? Were there any other conditions put on you as part of the sentence? You may need to call the State Atty's. office or contact the judge's chambers to ask for the capias to be WITHDRAWN.

'Hope this helps. Tom Rosenblum
