Failure to Register in Florida

My 26 yr old committed indect liberties when he was a 15 yr old after he was raped himself in a hospital by his roommate. He spent 7 yrs in prison and has been out for 2 yrs now. He is a registered sex offender and he is on 3 state lists at this time.He was arrested a month after he got out of prison for a probation violation ,and spent 3 months in jail, however he was never on probation. Two days ago he again was arrested in Tennessee at 4 am at his hotel for ''Failure to Register in the State of Florida''. My son has registered in every state and every time he has moved since he got out of prison, however, the State of Florida is saying he did not let them know he was moving from Florida to Tennessee. However,he did go to the Sherrifs Dept. in Polk County, Fla, and let them know he was moving 48 hours before he left the state. He registered the first hour he got into Tennessee two days later. He is now being held in Tennessee awaiting extradition to Florida for a 3rd degree felony and 5 yrs in prison.He has done everything by the letter of the law since he was let out of prison. Our family does not have much money. What can we do to help him not have to spend 5 yrs in prison for something we beleive he is innocent of?

I can help you with this. I am very familiar with how difficult these situations are. There is, as you know, A zero tolerance for even a perceived violation of one of these registration laws.

I was a prosecutor for 17 years before starting to do defense work. For almost 15 I spent in sex crimes. From 2003 until this past July I was chief of the felony division for 4 years for the State Attorney's Office in Fort Myers. I have tried cases all over the state including Bartow. My point is if anyone can help you I think I can.

i understand how tight money is and try very hard to work with people whenever I can.

The key to these types of cases is to try to get them dismissed or reduced PRIOR to trial, which if there is a way I will know it after reviewing everything. If these go before a jury they almost always convict because it's a sex offense and there is a hysteria over anything having to do with sex offenses.

Having said all this, I will handle this for you for $5,000. It doesn't matter that my office is in West Palm Beach. I can do most of the work over the phone and the computer and I actually enjoy traveling. There will be no additional fees for my costs. The fee is called a flat fee and covers all my fee and expenses.
