Legal Question in Criminal Law in Florida
I am in a false accusation criminal charge. I just obtained my discovery from the state. It have 1 police report that is supposed to be 7 pages and they only have me 1of7 and 2of7. Missing the last 5 pages. There is a witness report and another report I know that's in there from talking with a friend years ago, that would blow this shit out of the water. Is it legal for them to furnish just 2 pages of 7 in a police report and withhold any police reports. The case will most likely be dismissed on a technicality cause the charge doesn't fit the crime. But I would rather it be dismissed over the reports. I was actually the victim of a stabbing and refused to have charges filed. And my ex claimed I picked up her kid, ran 5 ft and placed him down and she pressed charges and I'm charged with involuntary servitude, which does not come close to what that charge should be. But anyway, there is an unbiased witness report that doesn't place the kid there and puts weapons in 2 of the 4 opposing parties hands. Which is in them pages. Is it legal for them to with hold them pages if it was part of the 1-7 reports.
1 Answer from Attorneys
To answer your main question, if a notice of discovery has been filed, then you are entitled to the full report. The bigger issue is why are you asking a detailed question like this on this forum. You need to keep this confidential with your attorney. If you are trying to do this on your own, DON'T. Get an attorney right away, of if you have one, talk to them right away about your concerns. They can fix these problems.
