Legal Question in Criminal Law in Florida

False Imprisonment

How is this determined. What had to happen to get charged with this? If someone claims I held them against their will but there is no actual proof only that persons say so how can I be charged. P.S. The person is lying lying lying. How do I foght this in court?

The way you would prove that is at trial. At trial you would have the opportunity to cross examine witnesses. The probelm is you never know what a jury will do and if they convict you are looking at 5 years florida state prison. After reviewing the facts of the case you should come to an informed decision, based on your level of risk you wish to assume. Some people will say if there is even a chance of prison, I do not want to go to trial. So the choice is really yours and yours alone.

I advise you to retain an attorney now if you can afford to. These "domestic" situations spin out of control really quickly. If the State has filed charges chances are they will go through with it to the end. You need strong representation to convince the "victim" and the State that the case should not go forward. You DO NOT want to take your chances in front of a jury. What county is this in?
