Legal Question in Criminal Law in Florida

I have been falsely accused of stealing from a vet clinic that I had taken my dog to on several occasions before finding out they were charging me for things they weren't doing. The State Attorney had this completely removed over 3 years ago and I never thought about it again. It has since been reopened by the clerks office. Apparently they switched their filling system over and had lost several of the documents. They said I needed to get in touch with the person from the state attorneys office and have her send them the papers they lost. Unfortunately, she no longer works for them and they refuse to help me. The clerks office says they can't do anything and that I have to schedule a court date. Also, every office has something different on file. One office also shows me having an active warrant out though the Sheriffs Office says that I don't have one and have never had one of file. Do I need to get a lawyer? Schedule a court date? I no longer have anything to back up what I am saying and am unable to get in touch with the person who resolved this originally. To make it worse, I lost my job of 2.5 years over this last week and am unable to get another one until this is removed. I have never taken anything from anyone and am worried about this whole thing.

Hello: I just read your question. Without knowing more facts, I can only give a brief response. When you say the State "completely removed" the case, does this mean the charges were dropped or you plead to the charge and the file was sealed? It doesn't matter who the Assistant State Attorney was, as they have a file and the Clerk's Office has a file on the case. You can ask to view the Clerk's file.

This does sound kind of strange. It should be able to be resolved easily. You should try to review their files. If there is something still open, you may need to ask to put the case on a judge's calendar and file some sort of Motion.
