Legal Question in Criminal Law in Florida
I have a family friend that was released from prison 11/2009 on conditional release. He re offended with a petit theft charge; it was upgraded to a felony because of 2 previous petit theft charges 10 years ago. Can he be sentenced under the Prison Re offender Act?

He will not be charged as a PRR. Though technically he might qualify for some other enhancement. Also, depending on the prior prison charge he could subject himself to the relatively new law Felony Offender of Special Concern, just something to understand in the future.
