Legal Question in Criminal Law in Florida
My father in law is in jail for a crime we was framed for. The evidence was seized (Swat style) with no warrant and we were intimidated into turning everything over to them (even though we didn't know there was anything that could actually hurt him there). With all the charges we now have to pay, the financial strain we are now in, the medical burden he now suffers, and the breaking up of a home, can the police department get away with everything that's happened? Is there anyway we can fight back?
1 Answer from Attorneys
Sure he can fight back. First and most important, get a qualified attorney. The attorney will fight this all the way to trial to file motions to suppress. Then take it to trial to show how we was framed. If those items were seized in a forfeiture, then the forfeiture of those items can be challenged. You need to talk to a local attorney now to fight this for him.
