Federal law is a very complex subdivision of the criminal law specialty, so there are exceptions to the rules. However, GENERALLY speaking, a motion for a "safety valve" is done in certain drug cases in order to avoid the mandatory minimum. The person has to have no more than 1 point in criminal history (typically one or none prior criminal record). And you have to cooperate with the government regarding the facts of the case, which involves a full debriefing between the government and the defendant. If you have a federal charge pending, you relly need to hire an attorney that handles federal criminal work.
