Legal Question in Criminal Law in Florida

I have a felony grand theft and misdemeanor check fraud charge on my record. They both are at least 3 years old, and I had adjudication withheld on both charges. According to what I've been told and what I've read on line, once I have successfully completed the terms of my probation (and I have done so already), the charges won't appear on my record. Is this true or would I need to get them sealed or expunged?

You've been misinformed. Completing probation successfully does not cause your record to be cleared of the offenses.

Now that you've completed your sentence, you may petition the court to have your record sealed. Both offenses qualify under Flirida law and both can be sealed, so long as they were a part of the same case. If you succeed in getting them sealed, you'll have to wait 7 years to petition to have them expunged and you cannot have any intervening charges during that time.

For a more thorough discussion of your case, feel free to call my office any time.
