Legal Question in Criminal Law in Florida
Felony Probatio Violation
My 21 year old son was found guilty last year of 2 counts of grand theft. Sentenced to 5 years probation & $10,000.00 restitution with the adjudication withheld until both conditions had been met. (He is a legal alien & if convicted of a felony would be deported after serving the sentence).
On a random drug test by his Probation Officer, he tested postive for marijuana. An arrest warrant was issued for violation of probation & he turned himself in.
Will he go to jail? Are there any other options the Judge will consider? What as his family (if anything) can we do to sway the outcome to a positive one? Please help.
