Legal Question in Criminal Law in Florida
My fianc is in trouble with possible house arrest. If I marry her will she be able to live with me outside of the state she got in trouble in while still being under house arrest? Male is 24 and female 23 (one in trouble)
1 Answer from Attorneys
It depends by what you mean when you say "house arrest." In Florida, a person can be confined to their home as a condition of release from jail, prior to any conviction or sentence. Alternatively, a person can be confined to their home as part of a community control, which is a very strict probation sentence.
If your fiance was already sentenced then she may be able to transfer the probation to another state and so she could live with you in a different state while still being confined to the home. On the other hand, if her case is still pending then it is very unlikely that she will be allowed to leave the state.
