Legal Question in Criminal Law in Florida

My Fiance was arrested for battery at a football game in Miami. I bailed her out and to date (two weeks) we have not gotten any info about her hearing date. We check the Dade County Clerk of Courts web site everyday but nothing changes, there is no date set. We try to call everyday but cant get through on the phone. We heard it was 21 days after the bond was paid but we are not sure. We are not sure what to do. We don't live in the Miami area so we would have to take an entire day off to attend and don't want to get it wrong. Is there another way to check for this date?

You are doing the right thing by staying in touch with the clerk. Make sure that your fiance's address with the clerk's office is up to date so that if and when they file charges, you will get notice. The state has up to the speedy trial period to file charges. For a misdemeanor battery, it is 90 days. It would be helpful if you had an advocate on your side, it would probably help your situation in not only fighting the charges, but also would allow you to rest easy because then the attorney would be required to get notice as well.

Sometimes the Dade County clerk is slow to update misdemeanor cases. I have waited for quite a while on previous cases. Unfortunately they usually have it done on the day before you are set to be in court.

If you were able to hire an attorney on this coast they could attend for you and make sure everything is handled properly.

Also, since this case is a misdemeanor the attorney may be able to attend for you at every future date.

I see that you are located in Fort Myers, I have an office there but live in Fort Lauderdale and handle criminal cases in Miami.
