Legal Question in Criminal Law in Florida

My fiance recently admited to smoking marijuana while on felony probation for grand theft he did not take a test he just told the truth and signed a paper its his first violation of felony probation and he was told he would receive a court date in the mail instead he was arrested tonight 1/8/13 his probation was requiring him to pay 125 restitution each month which he has done and has paid this month as well. We dont have any money, I am pregnant and the baby is due on the 31st of this month!! I am now on the verge of being homeless within a week!! With my currant condition I cant work and I just dont know what to do. He has never been in any other trouble this is his first time on probation being in any kind of trouble or even having anything on his record. I just dont know what to do if he does time i will be on the streets i have no family here in florida and no one to turn to please if someone could tell me what to do i would be forever grateful this is my first child and i just cant do this alone!! I really dont want to raise our child in a homeless shelter. My rent is due in a week and I'm scared. Please someone anyone, even a little legal advice would help. Thanks so much.

He is entitled to a public defender who can get him on a docket to be heard quickly so that he can get out and support you. I suggest you call the public defender's office and try to talk to his attorney and let them know your situation so that his case can be heard as soon as possible.
