Legal Question in Criminal Law in Florida
My ex and I had a fight where we both suffered bruises. No arrest was made and I did not report it to police. It is now 3 weeks later and he calls and says he filed a police report and is pressing charges for $300 damage to his vehicle and his bruises. I have pictures of my bruises but did not file anything. Nobody saw me damage his car. Does he have a case? Should I just give him some $ to keep him from pressing charges or does he not have a case with no witnesses at the scene?

Does he have a case for what? Battery? Criminal Mischief? Put it this way, he could contact the police and they will do an investigation as to whether there is probable cause to arrest you for battery or criminal mischief. Most important thing if that were to happen is to NOT talk to the police without having an attorney present. Now, on the other hand, if you don't dispute damaging his car, then by paying it, you will stay out of small claims court. But understand that paying him only prevents him from doing anything civilly and does not mean that you avoid criminal charges. While it sounds like he just wants the money, that may be the easiest thing to do but again talk to an attorney before doing anything.
