Can I file a police report on someone if they installed mobile spy on my cell phone and what would they get charged with?

You can contact the police anytime you feel you have been victimized by someone else. Without knowing any of the specifics of your circumstances, the police may find probable cause of a theft related crime in your scenario: theft of the cell phone, theft of the information on your cell phone, etc.
