Legal Question in Criminal Law in Florida
Fililing motion to dismiss
Have been charged with prostitiution and an add charge of batery on a LEO. I am told I have to discharge her in order to file a motion to dismiss . She is in essence telling me to to plead guilty to an unwarrranted charge that I am by NO MEANS guilty of. Please contact me ASAP.

You dont have to plead guilty ever to a criminal charge. However, the attorney decides what motions to file. Motions to dismiss are only appropriate in limited situations. I handle Broward cases frequently if you are looking to hire private counsel.
