You're probably going to need an attorney to help interpret, but look at Chapter 921 of the Florida Statutes. Various sections in there talk about sentencing. However, even if you know the point system backwards and forwards, the state can sometimes add points for things like injury points, legal status violation, domestic situations, etc. So, your boyfriend needs to talk to his attorney to get a better idea of his sentence.

Whether your boyfriend will "score" state prison or not depends on a variety of factors. The calculations consist of an offense severity chart for the current charges, prior criminal history, and a variety of other factors such as gang affiliation, drug trafficking, and the degree of injury, if any, to the victim. These criteria are all outlined in the Florida Statutes, chapter 921, which you can find here: www.leg.state.fl.us/statutes.

However, the sentencing guidelines are very complicated. I would suggest that you or your boyfriend consult an attorney to assist you. If you would like to discuss your particular situation, I would be happy to spend some time going over the guidelines with you. Please feel free to contact me at your convenience.
