Legal Question in Criminal Law in Florida
FL. Ord. 562.111(1)
For possession of alcohol under 21. "beverage on bench to wit": one green soto cup containing beer. defendents age being 17. Evidence desroyed on seen". Is their any statuate to fight this or make an appeal ? when speaking to the officer she stated the defendant was not drinking. Although she did not write that in the statement. Is there anyway to to fight, or should fine be paid?? Pleas answer ASAP!

FIGHT IT !! The element of possession must be proved by evidence not supplied by the defendant. And there is an issue as to control, who had control of the area,was there anyone else around, was it a public place?? etc.... GOOD LUCK.
