Legal Question in Criminal Law in Florida
If the Florida court orders an evaluation for incompetency to determine whether a violation of felony probation was willfully committed, can the violator be competent at the time of the evaluation and still be found incompetent when the violation occurred? In other words, can you be competent when you undergo an evaluation to determine incompetency at an earlier time?
