Legal Question in Criminal Law in Florida
Florida Criminal Record on File
I was arrested for resisting arrest in March of 2001 during spring break. The charges were reduced to a misdemeanor.
1. Do I have to claim this on a job application?
2. Will this show up on a background check 7 years later?
Thank You.

Re: Florida Criminal Record on File
Whether or not you have to claim it on a job app. Depends on the question.
Most jobs would ask a question that would require you to answer "Yes".
And yes it will be on your record unless it is sealed or expunged.
Depending on the disposition or sentence of your case, and prior record, you may be eligible for either a record sealing or expungement.
I would be happy to go over the process with you and come up with a game plan.

The answer to your question depends on how the case was reolved. You may also be qualified to seal the record. Please give me a call and we can figure that out.
Re: Florida Criminal Record on File
Whether you have to acknowledge the charges on the job application depends on the wording of the question. Most such questions ask whether have ever been arrested, which you would have to acknowledge.
However, depending on your personal circumstances, you may be able to seal your record, which would then allow you to deny the charges to all but a few entities (like the FBI, for instance.)
If you would like to discuss whether or not you qualify for sealing, and if so, begin that process, please contact my office.
