Legal Question in Criminal Law in Florida
In florida, if someone is in drug court because of commiting a burglary under the influence of drugs and has been assessed to qualify for a drug program, can the judge still agree to the program when the public defender is fighting for it and the assistant state attorney is against it?

Potentially the answer is yes. Most diversrion programs are discretionary with the state except for drug related offenses where the judge is allowed some discretion. Talk to your public defender about the pros and cons of drug court to see which is the better avenue for you.
