can a florida public defender refuse a power of attorney? my brother is in the bay county jail, he signed a power of attorney for us to be able to have contact with his public defender and get info on the case and talk with her. she is refusing to speek with us.

No attorney has to talk to or give information to anyone other than the client. However, attorneys should answer reasonable questions asked by family members. However, sometimes the client and the family members are hounding the PD/attorney to death and the PD/attorney just ignores them except for representation. If you are having getting reasonable questions answered, I suggest you call the elected Public Defender for the APD's circuit and make a complaint. Remember, PDs have very heavy caseloads and very little time for themselves. Contacting clients' family members is extra work they often try to avoid.
