Florida Statute 322.03

My 14 year old son was issued a traffic citation (above) for operating a "go-ped" (33cc 2 cycle engine on mounted on a traditional human powered scooter (no seat or seat pedestal) with an upright T shaped steering bar and 2 six inch wheels with a top speed of 18 mph. It is not a "moped".

1. What is the legal definition of a "moped"?

2. What is the legal definition of a "go-ped"?

3. Does the state of Florida have any applicable

laws associated with "go-peds".

4. Can a "go-ped" be legally descibed as a motor

vehicle?

A "go-ped" which is a motorizied scooter driven standing up with the controls on elevated handles, is a motor vehicle under Fl. Stat. s 322.34, and thus requires a valid drivers license for operation. See; State v. Riley 698 So.2d. 374 (2nd DCA 1997).
