Florida Warrant - Extradited to Florida

My brother, 4 years ago, performed felatio on a 17 year old girl. They are calling it a 1st degree felony. Initially, he was brought in, questioned, took a lie detector test (and passed), and released. He moved to Washington state from Florida, where this happened. Yesterday, the police arrested him at his home on a warrant from Florida. We thought the case had been dropped. What can we expect?

Hey. I just read your question. I see an attorney answered, but he wasn't real specific, so I want to supplement that and provide you with a source in North Fla. should you need that. You do not state whether your bro. was sent to Fla. If that hasn't happened, the police dept. up there will notify The police dept. where the warrant originated.

The originating dept. will contact the State Attorney's office to find out if they want to have the Defendant brought to Fla. If the case was dropped as you surmised, they will notify the authorities that are holding him up there. If that happens, he may have a law suit against the Police dept. and city where the case originated.

If there still is a case, he may be extradited to that city for prosecution. It is a fairly serious crime, but there are factors that may mitigate the seriousness here, such as...if he has no prior record, whether they were dating, whether he passed a polygraph test, or whether she has made some inconsistent statements.

If he is charged with this, he should obtain an attorney whether private or a public defender. 'Hope this helps. Tom Rosenblum
