forfeiture
I own a car dealership and financed a car for someone I know and he was arrested for trafficing. I am the lein holder and the truck has never been paid off and I hold the title. I want my truck back and the police are keeping it from me. Can they do this or can I go to the police station with the title and pick it up? He wasn't even in the vehicle when he was arrested, it was 20 miles from where he was arrested.

The police will proceed with a forfeiture and a defense is that it is not his car. You should call the attorney for the police or have your lawyer do so.

Hello: I just read your question and the one ans. and would add...You should contact the State Attorney's Office and ask for their forfeirure Div. and advise that you own the car. They probably will need to see proof of the lien. This should stop the forfeiture. The sheriff's Office may need time to investigate the car for any evidence that will help their case, but that should not take that long. Good luck. Tom Rosenblum
