Legal Question in Criminal Law in Florida

Fourth offensive of driving with a revoked license

I would like to know what the usual penalty for this offense is.

I have heard that you can get up to five years in jail. Is there anyway to get a lesser sentence?

Re: Fourth offensive of driving with a revoked license

If you have been CONVICTED of Driving With a Suspended License (DWLS) two times, then your third conviction CAN result in a FELONY of the 3rd degree, punishable by up to 5 years in jail, and a $5000 fine. Are there any defenses?

YES.....

Depending on the facts of your case, your record, how you were found guilty in the prior DWLS, if there is a certified record of the conviction, if you had counsel, if you knowingly, and voluntarily plead to the charge, if you had knowledge of the suspension.... and on and on. To put these defenses forth you really need to speak with a criminal defense attorney. The bottom line there is hope. GOOD LUCK....
