Legal Question in Criminal Law in Florida
I am asking a free legal question. My friend is on felony DWI probation and just got caught driving while under the influence again. She bonded out of jail. Should she contact her probation officer first or talk to an attorney first? Also do you think she will get violated before any of this could take place?
1 Answer from Attorneys
She should definitely speak with an attorney. It is entirely possible, and probable, that she will be violated before she has an opportunity to even meet with an attorney or her probation officer. Usually the police are pretty diligent about arresting someone for a VOP if they are on probation and get arrested for a new law offense.
Your friend absolutely NEEDS an attorney. A conviction for a 2nd DUI within 5 years of a previous DUI comes with mandatory jail time, not to mention other consequences.
