Legal Question in Criminal Law in Florida

My friend has been arrested for violation of probation. Probation officer found an unopened bottle of wine in the house that was his companions who is not a regular drinker. When the probation officer proceeded to arrest she did not have a breathalyzer and denied the request of my friend to test him. However, in the garage there was an empty small bottle of vodka, which he admitted to being his from a previous time. the probation officer is recommending to the judge that he can\'t return back to his home because of the bottle of unopened wine. This is his home and his companion would be happy to not have alcohol in the home at all. Can this be fought? This is a first offense on the probation can he fight severity in consequence?

In order for a probationer to be found guilty, their actions must be willful. These actions do not sound like they are. That said, you should probably talk to an attorney in your area about the best strategy to use for this case.
