Legal Question in Criminal Law in Florida
My friend was involved in an altercation with her ex & the filed a report with the police. The police tried to contact her and she never met with the officer to give her side of the story. she was never arrested for those charges but we found it online but the police haven’t been able to serve the summons and there is a court date set. So I’m just curious what happens when they’re not able to serve her the summons. will a warrant be issued for her arrest? Will the case be thrown out? I read on the summons that it says it’s just for "answering questions". The police still haven't been able to serve her or anything so on record she has no knowledge there's a summons for her. If she were to go to court could they arrest her? Is truly just for questioning? Could it turn into a warrant? The ex wants to drop the case, but it's with the state for 2 counts of domestic battery.

Answering this question really requires an in-depth meeting with an attorney in person. To answer the first question is I don't see any reason they can arrest her without a warrant. Is there a warrant? As to your second question it's hard to say whether it's just for questioning. As to your third question it is possible it could turn into a warrant but there are so many details that should not be discussed in this public forum which is why I suggest you talk to an attorney in person.
